Welcome to The Generals Youth Football and Cheerleading Association ("TGYFCA," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our mobile application and website (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction

  • Be a parent, legal guardian, or authorized caregiver of athletes you register

  • Provide accurate and complete information during registration

  • Have the legal authority to agree to these Terms on behalf of yourself and your registered athletes

Minors: Children under 18 may not create accounts. All athlete registrations must be completed by a parent or legal guardian.

3. Account Registration

3.1 Account Creation

You must create an account to access most features of our Services. You agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your information as needed

  • Keep your password confidential and secure

  • Notify us immediately of any unauthorized access

  • Not share your account credentials with others

3.2 Account Responsibility

You are responsible for all activities that occur under your account, including actions taken by your registered athletes if they access the app through your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 One Account Per Person

Each adult should maintain only one account. Multiple accounts for the same person may be merged or removed.

4. Use of Services

4.1 Permitted Use

Our Services are provided for the purpose of:

  • Registering athletes for TGYFCA programs

  • Managing family and athlete information

  • Communicating with coaches, teams, and league administrators

  • Viewing schedules, events, and announcements

  • Processing registration payments

  • Accessing team rosters and contact information

4.2 Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose

  • Provide false or misleading information

  • Impersonate another person or entity

  • Attempt to gain unauthorized access to any part of the Services

  • Interfere with or disrupt the Services or servers

  • Upload malicious code, viruses, or harmful content

  • Harvest or collect user information without consent

  • Use the Services for commercial purposes unrelated to TGYFCA activities

  • Share inappropriate content or communications

  • Harass, bully, or intimidate other users, coaches, or athletes

  • Use the Services to contact minors other than your own children without parental permission

5. Registration and Payments

5.1 Registration Fees

Registration fees are set by TGYFCA and may vary by sport, season, and program. All fees are displayed before payment confirmation.

5.2 Payment Processing

Payments are processed securely through a PCI-DSS compliant payment processor. By providing payment information, you authorize us to charge the applicable fees.

5.3 Refund Policy

Refund requests are handled on a case-by-case basis according to TGYFCA's refund policy:

  • Before team placement: Full refund minus administrative fee

  • After team placement: Partial refund may be available with documentation (medical or relocation)

  • After season start: Refunds generally not available except for documented medical reasons

  • Administrative fees: Non-refundable

5.4 Financial Assistance

TGYFCA may offer scholarships or payment plans for families demonstrating financial need. Contact us for more information.

6. Athlete Participation

6.1 Eligibility Requirements

Athletes must meet TGYFCA's eligibility requirements for their respective programs, including:

  • Age restrictions based on sport and division

  • Residency requirements (if applicable)

  • Required documentation (birth certificate, proof of residence)

  • Medical clearance if returning from injury

6.2 Medical Information

Parents and guardians must provide accurate medical information for athlete safety, including:

  • Emergency contact information (minimum two contacts)

  • Known allergies (food, medication, environmental)

  • Medical conditions that may affect participation

  • Current medications

  • Physician contact information

  • Insurance information

Failure to disclose relevant medical information may result in removal from activities for safety reasons.

6.3 Assumption of Risk

Participation in youth sports involves inherent risks, including but not limited to:

  • Physical injury (sprains, fractures, concussions)

  • Heat-related illness

  • Contact with other players or equipment

  • Muscle strains and overuse injuries

By registering an athlete, you acknowledge and accept these risks. You agree that TGYFCA, its coaches, volunteers, and staff are not liable for injuries that occur during normal sports activities, except in cases of gross negligence or willful misconduct.

6.4 Concussion Protocol

TGYFCA follows established concussion protocols. Athletes suspected of having a concussion:

  • Will be immediately removed from play

  • Must be evaluated by a qualified healthcare provider

  • Must provide written medical clearance before returning to play

7. Code of Conduct

7.1 Athlete Code of Conduct

All athletes are expected to:

  • Show respect to coaches, officials, teammates, and opponents

  • Demonstrate good sportsmanship at all times

  • Follow team rules and coach instructions

  • Attend practices and games as scheduled

  • Wear appropriate equipment and uniforms

  • Refrain from using inappropriate language

7.2 Parent and Guardian Code of Conduct

All parents and guardians are expected to:

  • Support and encourage your athlete in a positive manner

  • Respect coaches, officials, and other parents

  • Refrain from coaching from the sidelines

  • Avoid negative comments about athletes, coaches, or officials

  • Address concerns through proper channels (not during games)

  • Model good sportsmanship for your children

  • Ensure your athlete arrives on time and is picked up promptly

  • Notify coaches of absences in advance

7.3 Violations

Violations of the Code of Conduct may result in:

  • Verbal warning

  • Written warning

  • Game or practice suspension

  • Season suspension

  • Permanent removal from TGYFCA programs

Severe violations (violence, threats, harassment) may result in immediate removal without warning.

8. Communication Policies

8.1 Official Communications

TGYFCA uses the mobile app and email for official communications. Parents and guardians are responsible for:

  • Keeping contact information current

  • Monitoring communications from coaches and administrators

  • Responding to time-sensitive requests promptly

8.2 Coach-to-Family Communication

  • Coaches communicate with parents and guardians, not directly with minor athletes

  • Communications occur through official TGYFCA channels (app or team email)

  • Parents and guardians have access to all communications regarding their children

  • One-on-one electronic communications between coaches and minors are prohibited

8.3 Social Media

  • Official TGYFCA social media accounts are managed by authorized administrators

  • Coaches should not "friend" or "follow" minor athletes on personal social media

  • Team social media groups (if any) should include parents and guardians

9. Photo and Video Release

9.1 Consent

By registering an athlete, you grant TGYFCA permission to:

  • Photograph and video record your athlete during TGYFCA activities

  • Use these images for TGYFCA promotional materials, website, social media, and newsletters

  • Share team photos with other registered families

9.2 Parent Photography

Parents may photograph their own children and team activities. When sharing publicly:

  • Be mindful of other children's privacy

  • Avoid posting unflattering images of other people's children

  • Do not tag or identify children who are not your own

10. Safeguarding and Child Protection

10.1 Our Commitment

TGYFCA is committed to the safety and well-being of all athletes. We maintain:

  • Background check requirements for all coaches and volunteers with athlete contact

  • Training on child safety and appropriate boundaries

  • Clear reporting procedures for concerns

  • Zero tolerance for abuse, harassment, or inappropriate conduct

10.2 Reporting Concerns

If you observe or suspect inappropriate conduct involving a minor:

  • Report immediately to a TGYFCA administrator

  • Contact local authorities if there is immediate danger

  • Email info@thegeneralsyfca.org for non-emergency concerns

All reports are taken seriously and investigated promptly.

10.3 Two-Deep Leadership

TGYFCA encourages two-adult supervision whenever possible. One-on-one situations between an adult and a minor athlete should be avoided.

11. Intellectual Property

11.1 TGYFCA Content

All content, features, and functionality of the Services (including text, graphics, logos, and software) are owned by TGYFCA and protected by intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes related to TGYFCA activities.

11.3 User Content

By submitting content (such as photos or comments), you grant TGYFCA a non-exclusive, royalty-free license to use, display, and distribute such content in connection with our Services and promotional materials.

12. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information and your children's information. Please review our Privacy Policy at https://thegeneralsyfca.org/privacy-policy.

13. Disclaimers

13.1 "As Is" Basis

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

13.2 No Guarantee

We do not guarantee that the Services will be uninterrupted, error-free, or secure. We are not responsible for any delays, failures, or interruptions.

13.3 Third-Party Content

We are not responsible for content posted by other users or third parties.

14. Limitation of Liability

To the fullest extent permitted by law, TGYFCA and its officers, directors, volunteers, coaches, and affiliates shall not be liable for:

  • Any indirect, incidental, special, or consequential damages

  • Loss of data, revenue, or profits

  • Personal injury or property damage resulting from your use of the Services or participation in TGYFCA activities (except as required by law)

Our total liability shall not exceed the amount you paid to TGYFCA in the twelve (12) months preceding the claim.

Note: This limitation does not apply to injuries caused by gross negligence or intentional misconduct.

15. Indemnification

You agree to indemnify, defend, and hold harmless TGYFCA and its officers, directors, volunteers, coaches, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Your conduct or your athlete's conduct at TGYFCA events

16. Termination

16.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Termination does not entitle you to a refund of registration fees.

16.2 By Us

We may suspend or terminate your account at any time for:

  • Violations of these Terms or Code of Conduct

  • Non-payment of fees

  • Conduct detrimental to TGYFCA or its members

  • Any other reason at our discretion

16.3 Effect of Termination

Upon termination:

  • Your right to use the Services ceases immediately

  • Your athlete or athletes may be removed from team rosters

  • Outstanding fees remain due

  • Provisions that by their nature should survive termination will remain in effect

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the issue informally for at least 30 days.

17.2 Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

17.3 Jurisdiction

Any disputes arising from these Terms shall be resolved in the state or federal courts located in Georgia.

17.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

  • In-app notifications

  • Email to registered users

  • Notice on our website

Your continued use of the Services after changes constitutes acceptance of the updated Terms.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable registration agreements, constitute the entire agreement between you and TGYFCA regarding the Services.

19.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19.4 Assignment

You may not assign your rights under these Terms without our prior written consent.
